PUBLIC NOTICE INVITING SUBMISSIONS UNDER SECTION 223

Carriageway easement over part of Jack Edwards Reserve, Oakleigh

PROPOSED ROAD DISCONTINUANCE

Monash City Council (Council), acting under clause 3 of Schedule 10 to the Local Government Act 1989 (Act), proposes to discontinue the road comprising a carriageway easement registered in dealing no. 1191646 and encumbering part of the land contained in certificate of title volume 4955 folio 904 which is shown hatched on the plan below and retain the land (Proposal).

A person may make a submission on the Proposal. Submissions must be submitted by no later than the close of business on 3 April 2023.

Any person making a submission is entitled to request in the submission that the person wishes to appear in person, or to be represented by a person specified in the submission, at a meeting to be heard in support of that submission.

All submissions will be considered in accordance with section 223 of the Act.

Any person requesting to appear in person or to be represented by a person specified in his or her submission may speak to their submission (or have a person speak on their behalf) at a meeting of a Committee of Council comprising the Oakleigh Ward Councillors and the Mayor on 11 April 2023 at 6.30pm to be held at Council’s offices at 295 Springvale Road, Glen Waverley.

Following consideration of submissions Council may resolve not to discontinue the road or any part of it or to discontinue the road or any part of it and retain the land.
