October/November 2023 - VCAT decision on Section 87A application

The matter proceeded to a compulsory conference on 24 October 2023 where Council officers and the permit applicant resolved to consent to the matter. VCAT's order on 3 November 2023 directs that an amended permit will be issued.

August 2023 - VCAT Section 87A application 

A Section 87A application to amend the approved development plans under Planning Permit TPA/51498A has been lodged with the Victorian Civil and Administrative Tribunal (VCAT).

The applicant has applied directly to VCAT to amend the approved development plans associated with the amended planning permit TPA/51498A issued on 8 June 2023 for the development of a 7-storey building comprising commercial and residential uses.

Specifically, the requested changes are to:

  • Add 2 additional apartments on the north-eastern boundary of the development at level 6
  • Change some floor-to-ceiling heights with minor increase in overall building height.

April 2023 - Council approval

At its April 26 meeting, Council resolved to issue a Notice of Decision to Grant an Amended Planning Permit (TPA/51498A) for 12-14 Johnson Street and 1 Mill Road, Oakleigh, for the construction of a mixed-use development inducing office and retail and a reduction in car parking.

Council sought community feedback on the proposal and received 9 objections.

There are a number of requirements to this amended planning permit.

March 2023 - Amended plans

Council sought community feedback on the amended plans to the existing Planning Permit TPA/51498 pursuant to Section 72 of the Planning and Environmental Act 1987 at 12-14 Johnson Street and 1 Mill Road, Oakleigh.

The applicant has submitted amended plans after public notification of the amendment application under TPA/51498A.

Public notice of the original amendment application TPA/51498 was undertaken between 8 December 2022 to 9 January 2023.

Feedback on the amended planning permit was formally sought by 11 April 2023. However, Council continued to accept submissions on this proposal up until it made a decision.

All original objections remained valid to this application and process.

About the proposal

The application seeks a number of significant amendments to amended plans previously advertised, including the following:

  • Redesign of Haughton Road entrance structure.
  • Façade materials simplified with deletion of green colourbond, green glazed bricks, and white precast paneling and incorporate brick at lower levels with lighter render on the upper levels.
  • Deletion of upper-level apartments (Apartments 605 & 606) and revised layout of Apartment 505 with increased setbacks towards the east and north.
  • Redesign of balconies of Apartments 305, 405 and 505.
  • Setback of the planter on level 6 increased from 4.5m to 5.2m from the southern boundary.
  • Balconies of Apartments 110, 210, 306, 406 & 506 swapped to the east side of the apartments and reduction of screening to the balconies.
  • Vertical fins introduced to prevent internal overlooking between the apartments. Similar screening also applied to Apartments 111, 211, 307, 407 and 507.
  • Deletion of the cantilever of podium level marble towards the Johnson Street and Mill Road intersection.
  • Internal rearrangement of apartment layouts as a result of the above amendments.

Background

Council sought community feedback on the application to amend the existing Planning Permit TPA/51498 pursuant to Section 72 of the Planning and Environmental Act 1987 at 12-14 Johnson Street and 1 Mill Road, Oakleigh.

About the proposal

The application TPA/51498 sought a number of significant amendments to original approved plans, including the following:

  • To include the adjoining site known as 1 Mill Road, Oakleigh, in the development
  • To change the use of the approved development from office and retail uses to residential and retail uses:
    • Residential dwellings: increased from 0 to 70 apartments
    • Retail: remains to be 2 tenancies (overall floor area reduced from 272 to 219.3 square metres)
    • Commercial: four tenancies (overall floor area reduced from 2,957 to 747.2 square metres)
  • Proposed residential apartments:
    • 13 x 1-bedroom dwellings
    • 54 x 2-bedroom dwellings
    • 3 x 3-bedroom dwellings
  • To reduce the floor to ceiling height of the residential floors (compared to the office floors)
  • To add an additional residential level to the development, resulting in a total number of storeys increased from 6 to 7
  • Maximum building height remains at 23m plus plant
  • Number of on-site car parking spaces increased from 32 to 82
  • Number of bicycle spaces increased from 30 to 88
  • Vehicle access is via a new double crossover from Mill Road.
