Notice of Intention to Lease - 65A Power Avenue, Chadstone

Monash City Council (Council) gives notice in accordance with Council’s community engagement policy and Section 115 of the Local Government Act 2020 that, having completed an expression of interest process, it intends to enter into an agreement for lease and lease with HousingFirst Limited ACN 116 093 004 (Tenant) for the land known as 65A Power Avenue, Chadstone 3148, being the land in certificate of title volume 8355 folio 142 (Land).  

The Land is shown outlined in blue on the aerial photo below.

The principal terms of the Agreement for Lease and Lease with HousingFirst Limited will be as follows:

  1. the grant of the Lease will be conditional on the Tenant obtaining:
    • a Planning Permit which authorises the use and development of the Land for social housing in accordance with schematic design and development requirements specified by Council and concept plans to be approved by Council; and
    • funding for the construction and provision of social housing on the Land
  2. the Permitted Use is the construction and provision of social housing (as that term is defined in the Housing Act 1983)
  3. the Lease will be for a Term of 50 years starting on the date which is 10 business days after the last of the conditions precedent have been satisfied, with no option for a further term
  4. the Rent payable under the lease is $1.00 per annum plus GST
  5. the Tenant must remain a registered agency under the Housing Act 1983 during the term of the lease; and
  6. the Tenant is responsible for:
    • constructing social housing on the Land in accordance with the planning permit and design documents approved by Council
    • payment of all outgoings and other charges assessed on the Land; and
    • maintaining and repairing the Land and all improvements constructed on the Land

In accordance with Council’s Community Engagement Policy, any person may make a submission in relation to the proposal to enter into the agreement for lease and lease with HousingFirst Limited.

Any person proposing to make a submission must do so by 5pm on 19 September 2023.

Any person making a submission may request to be heard in support of their submission. Any person requesting to be heard is entitled to appear in person or be represented by a person specified in the submission, at a meeting of a Committee of Council established for this purpose at 6.30pm on 10 October 2023 at the Monash City Council Civic Centre, 293 Springvale Road, Glen Waverley.

After considering all submissions, Council will decide whether to proceed with the proposed agreement for lease and lease with HousingFirst Limited.
